By using For Real Web Hosting and all offered services, you acknowledge your acceptance of all terms and conditions, and the following acceptable use policy.

ACCEPTABLE USE POLICY This Acceptable Use Policy document, including the following list of Prohibited Activities, is an integral part of your Hosting Agreement with For Real Web Hosting. If you engage in any of the activities prohibited by this AUP document For Real Web Hosting may suspend or terminate your account. For Real Web Hosting's Acceptable Use Policy (the "Policy") for For Real Web Hosting Services is designed to help protect For Real Web Hosting, For Real Web Hosting's customers and the Internet community in general from irresponsible or, in some cases, illegal activities. The Policy is a non-exclusive list of the actions prohibited by For Real Web Hosting. For Real Web Hosting reserves the right to modify the Policy at any time, effective upon posting at http://www.forrealweb.net/termsofuse.html. Prohibited Uses of For Real Web Hosting Systems and Services: 1. Transmission, distribution or storage of any material in violation of any applicable law or regulation is prohibited. This includes, without limitation, material protected by copyright, trademark, trade secret or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws. 2. Sending Unsolicited Bulk Email ("UBE", "spam"). The sending of any form of Unsolicited Bulk Email through For Real Web Hosting's servers is prohibited. Likewise, the sending of UBE from another service provider advertizing a web site, email address or utilizing any resource hosted on For Real Web Hosting's servers, is prohibited. For Real Web Hosting accounts or services may not be used to solicit customers from, or collect replies to, messages sent from another Internet Service Provider where those messages violate this Policy or that of the other provider. 3. Running Unconfirmed Mailing Lists. Subscribing email addresses to any mailing list without the express and verifiable permission of the email address owner is prohibited. All mailing lists run by For Real Web Hosting customers must be Closed-loop ("Confirmed Opt-in"). The subscription confirmation message received from each address owner must be kept on file for the duration of the existence of the mailing list. Purchasing lists of email addresses from 3rd parties for mailing to from any For Real Web Hosting-hosted domain, or referencing any For Real Web Hosting account, is prohibited. 4. Advertising, transmitting, or otherwise making available any software, program, product, or service that is designed to violate this AUP or the AUP of any other Internet Service Provider, which includes, but is not limited to, the facilitation of the means to send Unsolicited Bulk Email, initiation of pinging, flooding, mail-bombing, denial of service attacks. 5. Operating an account on behalf of, or in connection with, or reselling any service to, persons or firms listed in the Spamhaus Register of Known Spam Operations (ROKSO) database at www.spamhaus.org. 6. Unauthorized attempts by a user to gain access to any account or computer resource not belonging to that user (e.g., "cracking"). 7. Obtaining or attempting to obtain service by any means or device with intent to avoid payment. 8. Unauthorized access, alteration, destruction, or any attempt thereof, of any information of any For Real Web Hosting customers or end-users by any means or device. 9. Knowingly engage in any activities designed to harass, or that will cause a denial-of-service (e.g., synchronized number sequence attacks) to any other user whether on the For Real Web Hosting network or on another provider's network. 10. Using For Real Web Hosting's Services to interfere with the use of the For Real Web Hosting network by other customers or authorized users. Customer Responsibility for Customer's Users Each For Real Web Hosting customer is responsible for the activities of its users and, by accepting service from For Real Web Hosting, is agreeing to ensure that its customers/representatives or end-users abide by this Policy. Complaints about customers/representatives or end-users of an For Real Web Hosting customer will be forwarded to the For Real Web Hosting customer's postmaster for action. If violations of the For Real Web Hosting Acceptable Use Policy occur, For Real Web Hosting reserves the right to terminate services with or take action to stop the offending customer from violating For Real Web Hosting's AUP as For Real Web Hosting deems appropriate, without notice.

Prohibited Content
The following type of content will be prohibited from our services:

Any infringement of copyright, trademark, or other intellectual property right
Illegal software & Warez downloads
Hate and or terrorist propaganda
Racist, threatening, or otherwise abusive content
Content promoted through the sending of unsolicited e-mail (also known as spamming)
Sending of unsolicited e-mail (SPAM)
Mail fraud, multilevel marketing schemes or other fraudulent activities
The promotion, incitement of, or instruction for the commission of illegal activities
Information or other material that contains a virus, corrupted data or other harmful or damaging components
Illegal file sharing servers
Illegal unsolicited bulk email services
IRC Bots

Furthermore, we prohibit content which is defamatory, threatening, invasive, illegal, or otherwise violates any United States of America & Local law or gives rise to liability.

Adult Content
Legal (complying with 18 U.S.C. Section 2257) adult oriented and pornographic content is permitted if used responsibly and by legal methods on all For Real Web Hosting services.

Payment
Web Hosting recurring payments are due on the monthly anniversary of when the account was initiated. All payments should be made in advance to the services purchased. Invoices will be generated approximately ten days before the upcoming payment is due. Payments which exceed more than 48 hours late, and each seven days following will accumulate a 15% late fee (Invoices generated prior to 10/04/09 are still subject to the old 25% late fee).

Accounts not paid for may be temporarily suspended until payment is received. Accounts which are suspended are considered still in use by the customer, and billed for such time. If no payment is received within fourteen days of the original due date, the unpaid account will be eligible for termination.

Subscription payments are optional when checking out. This will make billing automated on the monthly anniversary of such subscription. All payments are completed through PayPal.com using the payment method of your choice of: Visa, Master Card, American Express, Discover Card, eCheck, or PayPal.

Domain Names
Domain name registration is offered for the prices listed. Domains can be registered for a period of up to 10 years at a time. The client is responsible for renewing their domain before its expiration date. We can not guarantee your domain will still be available unless you renew it three or more days prior to expiration. If you have the proper authorization code for a domain name as well as permission to move it, you can transfer domains from another registrar to us for the same price as we offer the domain. No refunds are available for domains already registered.

Free domain name registration is offered with each web hosting plan. Please consult the chart on the plan comparison page, which TLDs are available for free with what hosting plan. Free domains are applicable to new clients only. Payment for the web hosting account must be made prior to domain registration and is not applicable when paying by eCheck or any method which requires a clearance period. If payment for the first month's hosting is not received, the client voids applicability of a free domain and/or if payment is canceled, bounced, withdrawn, or refunded, the client agrees to be charged the retail cost and any resulting fees of the domain name. No domain name may be transferred from For Real Web Hosting if the related account has an outstanding balance, in which case the balance must be paid in full prior to the release of the related domain name.

Account Cancellation
If for any reason you are not satisfied with your service, please let us know. We build our services around making hosting simple for the customer and want you to be happy. If for some reason we cannot meet your needs, you may notify us and we will discontinue billing your account at the end of your current bill cycle. You may also request an account cancellation by logging into the client area. No refunds can be issued for services already paid for.

Please understand that when your account has been in use during a billing period, active, or suspended, you are still responsible to issue payment for any invoices and/or any late fees accumulated prior to canceling your account. Accounts with outstanding invoices must be paid before the account can be canceled.

Accounts eligible for termination due to nonpayment or service violations, could be canceled if the issue is not promptly dealt with. We hold no responsibility for lost data which may occur when an account is cancelled. Terminated accounts may be eligible to reopen if all invoices and late fees have been fully paid, and there will be a $25.00 service charge due.

Offered Storage Size
Our accounts all come pre established with 2,000 MB of storage. We will add your allotted disk space by request at no additional charge. If requesting the additional storage you agree that you must already be consuming 80% of your current disk space which does not include video, audio, or emails. Please contact an associate for additional disk space upgrades.

Excessive Resource Usage
Any web site that uses an excessively high amount of server resources including but not limited to CPU time, memory, and network bandwidth will be given an option of either upgrading their service level or reducing the resources used to an acceptable level. Failing to limit excessive resource usage will result in account suspension. Client caused excessive crashing, speed decline, etc. constitutes why we need to have this policy in order to keep other client's websites running efficiently.

Affiliate Program
Upon activating your account into the affiliate program, you will earn a 10% commission from all sales generated by new clients you refer through your affiliate link. Referred clients must be an active client for a minimum of 60 days in order to be issued any commission from the signup. Earnings will be paid out via For Real Web Hosting credit. There is a minimum payout level of $25.00. Affiliate earnings can not be refunded for accounts which are terminated due to terms of use violations.

Refusal of Service
We reserve the right at our sole discretion to refuse or cancel any service with or without notice. Violation of any of any of our terms of use, service policies, etc. may result in a warning, suspension, or possible account termination/cancellation. Refunds will not be issued for services already paid for.
