By using For Real Web Hosting ("www.forrealweb.net") services, you acknowledge your acceptance of all terms and conditions, and the following acceptable use policy.

ACCEPTABLE USE POLICY This Acceptable Use Policy document, including the following list of Prohibited Activities, is an integral part of your Hosting Agreement with For Real Web Hosting. If you engage in any of the activities prohibited by this AUP document For Real Web Hosting may suspend or terminate your account. For Real Web Hosting's Acceptable Use Policy (the "Policy") for For Real Web Hosting Services is designed to help protect For Real Web Hosting, For Real Web Hosting's customers and the Internet community in general from irresponsible or, in some cases, illegal activities. The Policy is a non-exclusive list of the actions prohibited by For Real Web Hosting. For Real Web Hosting reserves the right to modify the Policy at any time, effective upon posting at http://www.forrealweb.net/termsofuse.html. Prohibited Uses of For Real Web Hosting Systems and Services: 1. Transmission, distribution or storage of any material in violation of any applicable law or regulation is prohibited. This includes, without limitation, material protected by copyright, trademark, trade secret or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws. 2. Sending Unsolicited Bulk Email ("UBE", "spam"). The sending of any form of Unsolicited Bulk Email through For Real Web Hosting's servers is prohibited. Likewise, the sending of UBE from another service provider advertizing a web site, email address or utilizing any resource hosted on For Real Web Hosting's servers, is prohibited. For Real Web Hosting accounts or services may not be used to solicit customers from, or collect replies to, messages sent from another Internet Service Provider where those messages violate this Policy or that of the other provider. 3. Running Unconfirmed Mailing Lists. Subscribing email addresses to any mailing list without the express and verifiable permission of the email address owner is prohibited. All mailing lists run by For Real Web Hosting customers must be Closed-loop ("Confirmed Opt-in"). The subscription confirmation message received from each address owner must be kept on file for the duration of the existence of the mailing list. Purchasing lists of email addresses from 3rd parties for mailing to from any For Real Web Hosting-hosted domain, or referencing any For Real Web Hosting account, is prohibited. 4. Advertising, transmitting, or otherwise making available any software, program, product, or service that is designed to violate this AUP or the AUP of any other Internet Service Provider, which includes, but is not limited to, the facilitation of the means to send Unsolicited Bulk Email, initiation of pinging, flooding, mail-bombing, denial of service attacks. 5. Operating an account on behalf of, or in connection with, or reselling any service to, persons or firms listed in the Spamhaus Register of Known Spam Operations (ROKSO) database at www.spamhaus.org. 6. Unauthorized attempts by a user to gain access to any account or computer resource not belonging to that user (e.g., "cracking"). 7. Obtaining or attempting to obtain service by any means or device with intent to avoid payment. 8. Unauthorized access, alteration, destruction, or any attempt thereof, of any information of any For Real Web Hosting customers or end-users by any means or device. 9. Knowingly engage in any activities designed to harass, or that will cause a denial-of-service (e.g., synchronized number sequence attacks) to any other user whether on the For Real Web Hosting network or on another provider's network. 10. Using For Real Web Hosting's Services to interfere with the use of the For Real Web Hosting network by other customers or authorized users. Customer Responsibility for Customer's Users Each For Real Web Hosting customer is responsible for the activities of its users and, by accepting service from For Real Web Hosting, is agreeing to ensure that its customers/representatives or end-users abide by this Policy. Complaints about customers/representatives or end-users of an For Real Web Hosting customer will be forwarded to the For Real Web Hosting customer's postmaster for action. If violations of the For Real Web Hosting Acceptable Use Policy occur, For Real Web Hosting reserves the right to terminate services with or take action to stop the offending customer from violating For Real Web Hosting's AUP as For Real Web Hosting deems appropriate, without notice.

Harmful Scripts
Unsolicited Spam & Emails (Defined Here)

Furthermore, we prohibit the following from postings on this site; defamatory, threatening, invasive, encouraging of a criminal offense, or otherwise violate any law or give rise to liability.

Payment

Customers who are on recurring monthly plan are due to be billed upon their sign up date, and every month thereafter, on or about the same day of the month.
If your billing information has changed, then please contact us to update your billing subscription. If on your bill date, your credit card is declined, or payment is not made, you will get a notice that your account will be suspended for 5 days. If after this notice and 5 suspension days has passed your account may be interrupted temporarily and an email will be sent to the address on file to notify you of this problem. If payment is not arranged within 14 days, we will close your account, and any files will be lost. All prices are in US Dollars (USD). Any other payments, such as check or bank transfer must be received to be posted by the due date for your account, and handled through PayPal Inc.

Credit Card Payments
We safely handle all credit card transactions through the third party, PayPal.com for fast, reliable, and safe billing. If you have any questions of concerns based on the payment system, please contact PayPal Inc.

Free 5-Day Trial Period
The five day trial period is used to offer you time to verify your likings of our service, before you commit to recurring payments. Although PayPal billing information is collected when ordering, you will not be billed anything until 5 days of your order. If you are unsatisfied with our services, simply cancel your billing subscription through PayPal. We will gladly close your account for you, with no charges. Please note we can not refund services which have been pre-paid, or closed after the five day trial. Domain names are not included in this offer. Offer only valid with new hosting and reseller packages. Thank You.

Cancellation
If for any reason you are not satisfied with our services, please let us know. We build our services around making hosting simple for the customer and want you to be happy. If for some reason we cannot meet your needs, you may notify us and we will discontinue billing your account at the end of your current bill cycle. No refunds are issued for services already paid for.

Domain Name Registration & Renewal
Domain name registration is offered for $12.95 yearly, to all clients, upon registering for a plan. Please contact an associate for information on using a transferred domain with your account, and how to move it to our servers. Un-renewed domains can not be guaranteed available at a later time.

SSL and SSH Access
Some accounts offer SSL and SSH Access. This means you can create SSL and SSH certificates with your site. The actual certificates are not included with the regular pricing.

Offered Storage Size
Our accounts come pre established with 2000 MB of storage. We add additional disk space by requests at no additional charge. If requesting the additional storage you agree that you must 1) be already utilizing 80% storage capacity with the files being stored directly utilized for the website 2) not be utilizing storage capacity for emails 3) agree to have storage increased in 1000 MB increments up to the allotted maximum free storage offer. Please contact us and request it with the text "My site is already used XXXX Mb of YYYY Mb allowed. Please add additional 1000 Mb of the disk space."

Excessive Resource Usage
Any web site that uses an excessively high amount of server resources including but not limited to CPU time, memory, and network bandwidth will be given an option of either upgrading their service level or reducing the resource used to an acceptable level. Failing to limit excessive resource usage, will result in suspension or possible termination. Excessive crashing, speed decline, etc. may constitute an issue to this policy.

Refusal of Service
We reserve the right at its sole discretion to refuse or cancel service. Violation of any of any of our rules and regulations could result in a warning, suspension, or possible account termination. Accounts terminated due to policy violations will not be refunded.
